Thomas J. McIntyre

Tom focuses his practice on probate litigation, handling a diverse array of fiduciary litigation matters, including will contests, trust disputes, estate disputes, and other general equity matters.

Prior to joining Gilmore Rees & Carlson PC, Tom was an associate at Cushing & Dolan, P.C., where he handled probate and fiduciary litigation cases, and served as a Law Clerk to the Honorable Joseph A. Trainor of the Massachusetts Appeals Court.

Tom works on probate matters across multiple counties in Massachusetts, including Bristol, Essex, Middlesex, Norfolk, Plymouth, Suffolk, and Worcester counties. His practical approach to problems and strong analytical skills are the keystones of his practice.

Tom is based in the firm’s Wellesley office.

Representative Experience

  • Represented trustees in declaratory action concerning interpretation of a trust, secured successful dismissal of counterclaims, and reached a settlement with regard to all trust issues.
  • Represented trust beneficiaries in an action for trustee removal and reached successful settlement
  • Represented will and trust beneficiary against the personal representative and trustee regarding the decedent’s assets.
  • Represented personal representative and trustee in dispute over decedent’s shares of stock in closely held business and reached a successful settlement.
  • Represented trust beneficiaries in action to compel the trustee to make a distribution of trust assets and reached a successful settlement.
